Terms of Service

1. ELIGIBILITY

You must be at least 13 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet all eligibility requirements and that you have the authority to accept these Terms.

For users under applicable minimum age requirements, a parent or legal guardian must provide verifiable consent and supervision.

2. ACCOUNT REGISTRATION

To use certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your information.
• Maintain the security of your password.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account for any violation of these Terms.

3. USER CONTENT

You retain ownership of all text, photos, audio, video, documents, stories, and other materials you upload, create, or submit through the Services ("User Content"). By submitting User Content, you grant LifeHistoryApp a non-exclusive, worldwide, royalty-free license to:

• Store, display, process, reproduce, modify, and distribute your User Content solely for the purpose of operating and improving the Services.
• Generate PDFs, timelines, book layouts, and other outputs requested by you.
• Provide customer support and technical assistance.

You retain full copyright and may delete or download your User Content at any time, subject to backup retention periods.

3.1 Responsibility for User Content

You are solely responsible for the content you upload and affirm that:

• You have the legal right to use and share it.
• Your content does not infringe any copyright, trademark, privacy, or intellectual property rights of others.
• Your content complies with all applicable laws.

We may remove content or suspend accounts that violate these Terms.

4. PROHIBITED CONDUCT

You agree not to use the Services to:

• Upload unlawful, harmful, defamatory, obscene, or abusive material.
• Impersonate any person or entity, misrepresent your identity, or provide false information.
• Upload or distribute malware, viruses, or malicious code.
• Attempt to access another user's account or data without authorization.
• Reverse-engineer, decompile, scrape, or otherwise attempt to extract source code or proprietary algorithms.
• Interfere with the operation of the Services or attempt to circumvent security features.
• Use the Services for commercial hosting or storage unrelated to personal history, biography, genealogy, or related storytelling.

5. SUBSCRIPTIONS, BILLING & PAYMENT

Some features of LifeHistoryApp require paid subscriptions or one-time payments.

By purchasing any paid Services, you agree to:

• Provide accurate billing information.
• Authorize LifeHistoryApp or its payment processor to charge your payment method.
• Accept recurring billing for subscription-based services until canceled.

We reserve the right to modify pricing with reasonable prior notice.

6. DATA STORAGE & AVAILABILITY

LifeHistoryApp provides cloud storage for User Content. You acknowledge that:

• Storage limits may apply to free or paid tiers.
• We may offer expanded storage at additional cost.
• Temporary downtime may occur due to maintenance, updates, or unforeseen outages.
• We are not liable for data loss beyond what is required by applicable law.

7. INTELLECTUAL PROPERTY

All LifeHistoryApp technology, software, code, branding, designs, trademarks, and proprietary content ("LifeHistoryApp IP") are owned exclusively by LifeHistoryApp and protected by international copyright and intellectual property laws.

No license or rights are granted except as expressly stated in these Terms.

8. THIRD-PARTY SERVICES

The Services may integrate with third-party tools (e.g., cloud storage, printing services, payment providers). You acknowledge that:

• LifeHistoryApp is not responsible for the policies, performance, or security of third-party providers.
• Use of such tools is subject to their own terms.

9. TERMINATION

We may suspend or terminate your access to the Services at any time, with or without notice, if:

• You violate these Terms.
• Continued operation of your account poses security, legal, or operational risk.
• We discontinue the Services.

Upon termination, your account will be disabled. You may request a data export for a limited time, subject to retention policies.

10. DISCLAIMER OF WARRANTIES

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. LifeHistoryApp does not warrant that:

• The Services will be uninterrupted, error-free, or secure.
• User Content will never be lost or damaged.
• Outputs (including books, PDFs, layouts, etc.) will meet your expectations beyond reasonable professional standards.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• LifeHistoryApp shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising out of the Services shall not exceed the amount you paid to LifeHistoryApp in the preceding six months.

Some jurisdictions may not allow such limitations; in these cases, liability will be limited to the maximum extent allowed by law.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LifeHistoryApp, its officers, directors, employees, agents, contractors, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:

• Your use of the Services.
• Your User Content.
• Your violation of these Terms or applicable laws.

13. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Utah, without regard to its conflict of law principles.

Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in Utah County, Utah.

14. CHANGES TO THE TERMS

We may update these Terms from time to time. Changes become effective upon posting on this page, with the "Last Updated" date revised accordingly.

Continued use of the Services after changes constitutes acceptance of the updated Terms.
